USCIS announced on January 7, 2025, that it has reached the cap for the additional 20,716 H-2B visas for returning workers for the first half of FY 2025. These visas were for employment start dates on or before March 31, 2025, under the FY 2025 Temporary Final Rule (TFR). However, USCIS is still accepting petitions for the additional 20,000 visas allocated for nationals of Colombia, Costa Rica, Ecuador, El Salvador, Guatemala, Haiti, and Honduras, as well as petitions exempt from the H-2B cap. The FY 2025 TFR, effective December 2, 2024, provided these supplemental visas in two allocations. As of January 7, 2025, only 3,678 petitions have been received under the country-specific allocation, meaning visas remain available in this category. Employers are encouraged to act quickly to secure visas under the remaining allocation.
